Terms of Service

1. Acceptance of Terms

By accessing or using FlockPoster (“the Service”), operated by Lil Slice of Eden Gardening Inc (“we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

FlockPoster is a social media scheduling and management platform that enables users to schedule posts, manage multiple social media accounts, analyze performance metrics, and leverage AI-assisted content creation. The Service is available as a cloud-hosted platform and as a self-hosted open-source solution.

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Maintain the security of your account credentials and not share them with third parties
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 16 years of age to create an account and use the Service.

4. Subscription and Payments

FlockPoster operates on a credit-based pricing model through the Lil Slice of Eden Gardening Inc ecosystem. By subscribing to a paid plan, you agree to the following:

• Credits are purchased at the rate displayed at the time of purchase
• All payments are processed securely through Stripe and are subject to Stripe’s terms of service
• Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan)
• You may set usage rate limits to control credit consumption (e.g., maximum credits per hour or per day)
• Refunds are available within the first three (3) days of a new subscription upon request
• You may cancel your subscription at any time; access will continue until the end of your current billing period

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Post, schedule, or distribute content that is defamatory, obscene, hateful, or otherwise objectionable
• Engage in spam, unsolicited messaging, or automated bulk posting that violates platform guidelines
• Attempt to gain unauthorized access to other users’ accounts or our systems
• Use the Service to circumvent or violate the terms of service of any connected social media platform
• Reverse engineer, decompile, or disassemble any part of the Service (except as permitted by the open-source license)
• Use the AI features to generate content that is misleading, harmful, or violates intellectual property rights

6. Intellectual Property

FlockPoster’s core software is open-source and licensed under its respective open-source license. The FlockPoster name, logo, and branding are trademarks of Lil Slice of Eden Gardening Inc. You retain all rights to the content you create and publish through the Service. By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the Service.

7. Third-Party Integrations

The Service integrates with third-party social media platforms and services (including but not limited to Instagram, Facebook, X, LinkedIn, TikTok, YouTube, and others). Your use of these integrations is subject to the respective terms of service and privacy policies of each platform. We are not responsible for the availability, accuracy, or policies of third-party services. You acknowledge that connecting your social media accounts grants FlockPoster the permissions necessary to post, schedule, and manage content on your behalf.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the data practices described in our Privacy Policy.

9. Service Availability and Modifications

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that affect your use of the Service. We are not liable for any losses resulting from service interruptions or modifications.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Lil Slice of Eden Gardening Inc and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lil Slice of Eden Gardening Inc and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may request an export of your data within thirty (30) days of termination.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the “Last updated” date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Lil Slice of Eden Gardening Inc is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.
